Terms and Conditions for Program Participation · Effective 31 August 2026

These Terms and Conditions (“Terms”) govern participation in programs delivered by Vortex Athletics Pty Ltd (ABN 23 693 718 311) trading as VA HUB (“Vortex Athletics”, “we”, “us”, “our”). By enrolling your child in any Vortex Athletics program, you (“Parent”, “Guardian”, “you”) confirm that you have read, understood, and agree to be bound by these Terms.

Vortex Athletics delivers Speed & Agility and related youth sports programs at school venues across Brisbane, Queensland. Programs are designed for participants aged 5–18 years (“Participant”).

1. Enrolment & Eligibility

1.1 Enrolment is completed through the VA HUB platform or as otherwise directed by Vortex Athletics staff.

1.2 All participants must be under the age of 18. A parent or legal guardian must complete enrolment on behalf of the Participant.

1.3 Vortex Athletics reserves the right to decline or cancel an enrolment where it reasonably determines that participation is not in the best interests of the Participant or program group.

1.4 Enrolment is confirmed only upon receipt of full payment (or an accepted payment plan, where available).

2. Fees & Payment

2.1 Program fees are as displayed on the VA HUB platform at the time of enrolment. Fees are inclusive of GST where applicable.

2.2 Payment is due at the time of enrolment unless a payment plan has been expressly agreed in writing.

2.3 Vortex Athletics accepts payment by credit/debit card via the VA HUB platform (processed by Stripe).

2.4 All fees are non-refundable except as set out in clause 3 (Cancellation & Refunds) or as required by Australian Consumer Law.

2.5 Vortex Athletics may update program fees from time to time. Updated fees apply to new enrolments only and will not affect confirmed bookings already paid.

3. Cancellation & Refunds

3.1 Parent/Guardian-Initiated Cancellation. Where you wish to cancel your child’s enrolment:

Cancellation more than 24 hours prior to the program start date: full refund of fees paid, less any applicable processing fee.
Cancellation within 24 hours of the program start date: no refund, however a credit note valid for 12 months may be offered at Vortex Athletics’ discretion.
Cancellation after the program has commenced: no refund or credit for programs already commenced.

3.2 Vortex Athletics-Initiated Cancellation. If Vortex Athletics cancels a program or session due to circumstances within its control, a full pro-rata refund of unused fees will be provided.

If a session is cancelled due to circumstances outside Vortex Athletics’ reasonable control (including but not limited to weather, venue unavailability, or government direction), we will endeavour to provide a make-up session or credit. No cash refund is guaranteed in such circumstances.

3.3 Medical Withdrawal. If a Participant is unable to attend due to a medical condition diagnosed after enrolment, a credit note or partial refund may be granted upon provision of a medical certificate. Each request will be assessed on its merits.

3.4 Missed Sessions & Make-Ups. Where a Participant misses a session for any reason not attributable to Vortex Athletics (including illness, injury, holidays, or other commitments), no refund or credit applies to that session. We will, however, endeavour to offer one make-up session per Participant per term as a courtesy, subject to all of the following:

the make-up is requested at least 24 hours before the session the Participant wishes to attend, so that we can check numbers;
the make-up takes place within the same term, in the same program and activity type, at the same venue;
there is capacity in the make-up session, assessed by Vortex Athletics having regard to supervision ratios and venue limits; and
the make-up is confirmed by Vortex Athletics in writing before the Participant attends. A Participant must not attend a session they are not enrolled in without that confirmation.

A make-up session is offered at Vortex Athletics’ discretion. It cannot be exchanged for a refund or credit, does not carry over to a following term, and does not alter the Participant’s enrolled session.

4. Health, Medical Information & Emergency

4.1 You must disclose all relevant medical conditions, allergies, physical limitations, or other health information that may affect the Participant’s safe participation, at the time of enrolment and whenever circumstances change.

4.2 Vortex Athletics staff are not medical professionals. In the event of a medical emergency, we will call emergency services (000) immediately and attempt to contact you using the emergency contact details provided.

4.3 You authorise Vortex Athletics and its staff to consent to emergency medical treatment on your behalf where you cannot be reached, if a qualified medical professional determines it is necessary.

4.4 Participants must not attend sessions while unwell. If a Participant presents to a session with signs of illness, Vortex Athletics staff may send the Participant home.

4.5 Vortex Athletics does not administer medication. If a Participant requires self-administered medication (e.g. an EpiPen or asthma inhaler), you must ensure the medication is carried by the Participant and that staff are informed of its use and location.

5. Supervision & Child Safety

5.1 Vortex Athletics is committed to the safety and wellbeing of all Participants in accordance with Queensland legislation, including the Child Protection Act 1999 (Qld).

5.2 All Vortex Athletics coaches and staff hold a current Blue Card (Working with Children Check) as required under the Working with Children (Risk Management and Screening) Act 2000 (Qld).

5.3 Participants must be dropped off and collected by an authorised adult. Participants will not be released to any person not listed as an authorised contact unless you provide prior written notice.

5.4 Vortex Athletics operates a zero-tolerance policy toward bullying, harassment, discrimination, or disrespectful behaviour. Participants engaging in such conduct may be removed from the program without refund.

5.5 Any child safety concern observed or reported during a program will be managed in accordance with Vortex Athletics’ Child Safeguarding Policy and reported to relevant authorities where required.

6. Participant & Parent Behaviour

6.1 Participants are expected to follow reasonable instructions from Vortex Athletics staff, treat others with respect, and participate in a manner consistent with the Vortex Athletics Code of Conduct.

6.2 Parents and guardians are expected to communicate respectfully with Vortex Athletics staff and other families. Aggressive, threatening, or abusive behaviour will not be tolerated and may result in immediate removal from the program.

6.3 Vortex Athletics may terminate a Participant’s enrolment at any time for serious or repeated behavioural issues. In such cases, a pro-rata refund for unused sessions may be offered at Vortex Athletics’ discretion.

7. Liability & Assumption of Risk

8.1 Physical activity carries inherent risk of injury. By enrolling your child, you acknowledge and accept these risks.

8.2 Vortex Athletics takes reasonable steps to ensure programs are conducted safely. However, to the maximum extent permitted by law, Vortex Athletics excludes all liability for:

Personal injury sustained by a Participant during a program, unless caused by the negligence or wilful misconduct of Vortex Athletics;
Loss of or damage to personal property brought to a session;
Indirect, consequential, or special loss of any kind.

8.3 Nothing in these Terms excludes, restricts, or modifies any right or remedy you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other non-excludable statutory guarantee.

8.4 Where Vortex Athletics’ liability cannot be excluded, it is limited to re-supplying the relevant program or refunding the fees paid for that program, at Vortex Athletics’ election.

8. Intellectual Property

All training materials, program content, schedules, methodologies, and digital resources provided by Vortex Athletics are the property of Vortex Athletics Pty Ltd. You must not reproduce, distribute, or commercialise any such materials without prior written consent.

9. Privacy & Data

10.1 Vortex Athletics collects personal information (including health information) for the purpose of delivering programs, communicating with you, and ensuring participant safety. We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

10.2 Your information will not be sold or disclosed to third parties except where required by law, or to service providers who assist in program delivery (e.g. payment processors), who are bound by appropriate confidentiality obligations.

10. Changes to These Terms

Vortex Athletics may update these Terms from time to time. Updated Terms will be posted on the VA HUB platform and will apply to enrolments made after the updated effective date. We will provide reasonable notice of material changes.

11. Governing Law

These Terms are governed by the laws of Queensland, Australia. Any dispute arising out of or in connection with these Terms will be subject to the non-exclusive jurisdiction of the courts of Queensland.
